What is the purpose of this policy?
The purpose of this policy is to inform you about how your personal data is processed by GALERIE HELENE BAILLY MARCILHAC. The term “Personal Data” refers to any information relating to an identified or identifiable natural person, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to that person’s physical, physiological, genetic, mental, economic, cultural, or social identity. We invite you to read this policy carefully, as well as any other document relating to the processing of your Personal Data that we may provide to you.

HBM as data controller

GALERIE HELENE BAILLY MARCILHAC (hereinafter “HBM”): /galerie/mentions-legales/ determines the purposes and means of processing your Personal Data and, as such, acts as the data controller. The regulations applicable to the processing of Personal Data include all legislative and regulatory provisions, at national and European level, in force, including in particular: (i) Regulation (EU) 2016/679 on the protection of personal data of 27 April 2016 (the “GDPR”); (ii) the French provisions of Act No. 78-17 of 6 January 1978, as amended by Act No. 2018-493 of 20 June 2018; (iii) Directive 2002/58/EC of 12 July 2002; and (iv) the guidelines, opinions, recommendations, notices of supervisory authorities, and any certifications, approvals or final court decisions (together, the “Regulations”).

What data do we process?
We process the personal data that you provide to us directly, notably via the contact forms available in our premises, at fairs and other events in which we participate, available on our website, or through our written or oral exchanges.

The Personal Data we may process includes in particular:

your name;
your postal address;
your email address;
your telephone details;
your payment details and financial data, namely the name of your bank, your account number and sort code, if we need to make payments to you;
when you browse our website: your IP address, browser type and language;
information relating to your interest in artists, exhibitions, dinners and art fairs;
information about you that you provide to us in person at our events and art fairs, by completing forms on our website www.helenebaillymarcilhac.com
(for example in the “Contact us” section or to subscribe to our mailing list), or by corresponding with us by telephone, email, or otherwise;
information relating to the purchase of our artworks or the use of our services.

On what legal bases and for what purposes does HBM process your Personal Data?
HBM processes your Personal Data only to the extent strictly necessary to achieve the purposes detailed below, and on the following legal bases:

Compliance with a legal obligation:

Compliance with our legal and regulatory obligations, in particular regarding anti-money laundering (AML) and invoicing.

Performance of a contract:

Proper performance of contractual and pre-contractual relationships (payment assurance, taxation, delivery, etc.);
Offering services in line with your expectations.

Your consent:

Sending newsletters or commercial offers about HBM’s activities, and invitations to events;
Carrying out marketing, sales prospecting, and tailored solicitations based on your needs.

HBM’s legitimate interest:

Sending newsletters or commercial offers and invitations to events following your purchase of a product, in strict compliance with applicable legal provisions.

HBM will use your Personal Data only for the purposes listed above, unless it reasonably considers that the Personal Data must be processed for other purposes that are compatible with the original purposes. In any event, HBM will inform you of any such subsequent purposes.

Who are the recipients of your Personal Data?
HBM shares your Personal Data only with a limited list of people, solely in accordance with the purposes set out above and the tasks entrusted to them. Accordingly, the only recipients of your Personal Data are HBM’s internal staff responsible for sales and marketing management, and HBM’s data processors. HBM ensures that these recipients are required to implement appropriate security and confidentiality measures in order to comply with this policy. Data processors are not authorised to process your Personal Data for any purpose other than those provided for in Section 4. This data may also be transmitted to the competent authorities in order to comply with a judicial or administrative decision.

Cookies
“Cookies” are small data files placed on your device when you browse internet pages, subject to the choices you have expressed, in order to store and receive identifiers and other browsing information. Cookies are used on HBM’s website accessible at / (hereinafter the “Site”) to: (i) improve your experience on the Site by remembering your choices; (ii) produce visit statistics; and (iii) provide you with personalised content. Statistical cookies make it possible to compile statistics on Site traffic and to detect browsing issues, in order to monitor and improve the quality of our content. We use this information solely for statistical analysis purposes, after which the data is deleted from the system. Cookies do not give us access to your computer or to any information about you other than the data you choose to share with us. You can configure your browser at any time to express and change your preferences regarding cookies, including by refusing certain cookies (“Do not track”). You can also use the interface we provide via the cookie banner that appears when you first connect to the Site or after you delete your cookies. By disabling statistical cookies, your visit to the Site will no longer be included in our traffic measurement tools. This may prevent you from fully enjoying the website.

Are your Personal Data transferred outside the EU?
The data we collect from you is not transferred outside the European Union (EU), with the exception of the United Kingdom, a country that provides an adequate level of protection in this respect.

What security measures has HBM implemented?
HBM implements technical and organisational measures to protect your Personal Data against accidental or unlawful destruction, alteration, loss, disclosure or unauthorised access. These measures are regularly updated to ensure better protection, security, integrity and confidentiality of your Personal Data.

How long does HBM keep your Personal Data?
HBM keeps your Personal Data only for the period strictly necessary to manage our business relationship with you. However, data that makes it possible to establish proof of a right or a contract, and that must be retained to comply with a legal obligation, will be kept for the period required by applicable law. As regards potential marketing operations targeting customers, their Personal Data may be kept for three (3) years from the end of the business relationship. The Personal Data relating to a prospect who is not a customer may be kept for three (3) years from the date it is collected or from the last contact initiated by the prospect. At the end of this period, we may contact you again to ask whether you wish to continue receiving marketing communications.

What are your rights and how can you exercise them?
You have the following rights regarding HBM’s processing of your Personal Data:

i. Access and be informed: you have the right to be informed in a concise, transparent, intelligible and easily accessible manner about how your Personal Data is processed. You also have the right to obtain: (i) confirmation as to whether or not Personal Data concerning you is being processed by HBM and, where that is the case, (ii) access to all of your Personal Data and a copy of it.

ii. Rectification: if you consider that Personal Data concerning you is incomplete or inaccurate, you may ask HBM to rectify it, which HBM will do as soon as possible.

iii. Erasure: in certain cases, you may request that HBM erase your Personal Data (the “right to be forgotten”); however, this is not an absolute right, as HBM may, in certain cases, have legal or legitimate grounds to retain your Personal Data.

iv. Restriction: in certain cases listed in Article 18 of the GDPR, you may ask HBM to restrict the processing of your Personal Data.

v. Transfer: you have the right to data portability, meaning to receive your Personal Data in a structured, commonly used and machine-readable format. You are therefore free to transmit your Personal Data to a recipient of your choice, and HBM may not object. However, this right applies only where the processing is based on your consent or on the performance of a contract, and where the processing is carried out by automated means.

vi. Object: where the processing of your Personal Data is based on HBM’s legitimate interest, you may object to such processing. HBM will then stop processing your Personal Data unless it has a legitimate reason justifying the processing. You also have the right to object at any time to the processing of your Personal Data for direct marketing purposes. Lastly, you have the right to unsubscribe from our newsletter simply by clicking the “Unsubscribe” link at the bottom of each newsletter.

vii. Lodge a complaint: you always have the right to lodge a complaint with the French Data Protection Authority (CNIL).

viii. Set instructions after your death: these instructions, which may be revoked at any time, may relate to the retention, erasure or communication of your Personal Data by appointing a person responsible for carrying them out:

where general instructions are concerned, you may send them to a certified digital trusted third party approved by the CNIL;
where specific instructions are concerned, you may send them directly to HBM.

If you wish to exercise all or part of your rights, or obtain additional information, you may send a request to HBM at any time, together with a copy of proof of identity, enabling us to verify your identity:
